Applying for Probate: Check Eligibility and Inheritance Tax First

Before You Apply for Probate

When you are ready to apply for probate in England and Wales, the UK Government advises that you first confirm two things: that you are eligible to apply, and whether you need to pay Inheritance Tax.

Your application will be reviewed by the Probate Service after it is submitted.

Inheritance Tax Check

Before applying for probate, you must find out if you need to pay Inheritance Tax.

If You Plan to Use Probate Documents Outside the UK

If you order copies of your probate document for use outside the UK, these will take longer to arrive than your UK copy.

Additional Considerations for Applicants Living in the UK

If your right to live in the UK depends on your relationship with someone who has died, you might need to apply for a new visa. This situation may arise, for example, if your partner who died served as a member of HM Forces.
